Thirty years of tailor-made disputes, won, settled and pioneered.
Through various structures in France, the UK and Luxembourg, the GAI Group has funded and supported tailor-made disputes for thirty years. We work alongside London's leading litigation funds. Here are a few examples, presented with due respect for client confidentiality:

French electricity public service levy (CSPE)
GAI initiated the challenge to the CSPE, a French electricity levy partly used to fund objectives unrelated to its tax base. The litigation was conducted on a pure success-fee basis for major electricity consumers, including large retail groups, and led to a preliminary reference to the Court of Justice of the European Union.
OutcomeCJEU, 25 July 2018, Messer France, C-103/17: the Court upheld taxpayers' right to a partial refund of the levy. The French Conseil d'État applied the ruling on 3 December 2018.

Merchants v Visa and Mastercard: interchange fees
We set up a management pool with one of London's leading litigation funders. Through it, we support leading international brands in food service, retail and luxury watches. These retailers are seeking to recover the multilateral interchange fees imposed by the two card schemes.
Case lawOn 17 June 2020, the UK Supreme Court held that these fees infringed EU competition law (Sainsbury's v Visa / Mastercard, [2020] UKSC 24). In June 2025, the Competition Appeal Tribunal extended that finding to all the fees at issue in claims brought by hundreds of merchants. The proceedings continue on appeal.
